DMCA Takedown Requests

If you believe that content generated by TuneTaxi infringes upon your copyright, you are encouraged to submit a DMCA takedown request. To file a takedown notice, please provide the following information:

  1. Your Contact Information: Include your name, address, telephone number, and email address.
  2. Copyrighted Work: A description of the copyrighted work that you claim has been infringed.
  3. Infringing Content: A description of where the material that you claim is infringing is located on the TuneTaxi platform, with enough detail so that we are capable of finding and verifying its existence.
  4. Statement of Ownership: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy: A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Review Process

Upon receiving a DMCA takedown request, TuneTaxi will:

  • Review the request for completeness and validity.
  • Temporarily remove or disable access to the allegedly infringing content.
  • Notify the content provider, member, or user that we have removed or disabled access to the content.
  • Take reasonable steps to promptly notify the accused party that they can submit a counter-notice.

Counter-Notice

If you believe your content was wrongly accused or mistakenly removed due to a misunderstanding or misidentification, you may submit a counter-notice. Your counter-notice should include:

  • Your contact information.
  • Identification of the removed content and where it was located before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of a mistake or misidentification.
  • A statement consenting to the jurisdiction of your local federal court, if a lawsuit arises from this situation.
  • Your signature.

Upon receipt of a valid counter-notice, TuneTaxi will provide the original complainant with a copy of the counter-notice and inform them that the removed content may be replaced or access restored in 10 business days. If the complainant does not notify us that they have filed an action seeking a court order to prevent further infringement of the content on TuneTaxi, we may replace or restore access to the content.
